Nichia issued a press release today, stating that Everlight had previously filed an injunction lawsuit against Japan in accordance with the provisions on the Law on Unfair Competition Prevention. The Japanese Intellectual Property High Court dismissed Everlight on January 18, 2017. All requests.
In addition, Nichia has filed a patent against YAG in Germany, demanding that Everbright fulfill the injunction of the Dusseldorf Appeals Court and stop selling six white LED infringing products.
Nichia requires the company's German subsidiary to immediately recover and destroy all of the infringing products owned or held by its customers. It also did not comply with the order after the company issued a temporary injunction in the Dusseldorf court. The sale of Yiguang violated the Japanese YAG patented products and requested the Dusseldorf court to impose fines and obtain court approval.
In response to the press release issued today by Nichia, Yiguang said that the six old products have not been sold in Germany, have no impact on the rights and interests of customers, and the proceedings are still in progress. The judgment is not final and has appealed.
Yiguang further pointed out that Yiguang initiated an unfair competition law against Japan, which involved Japanese patent JP 4530094, the Japanese counterpart of US7531960 patent previously invalidated. Furthermore, in its European counterpart EP2197053, Yiguang received a preliminary opinion from the European Patent Office that the patent may be invalid.
In response to the judgment of the Japanese Intellectual Property High Court, Yiguang will appeal again and believe that the patent will eventually be invalid. In addition, the patent will expire on July 29, 2017.
Yiguang reiterated its consistent position of respecting intellectual property rights and fully defended the interests of customers and shareholders.
